 Terms and Conditions 

1. Our services: 
a) It is understood that One Vision Films is the exclusive Videographer retained by the client to cover outlined event. Any conflicts with other video coverage contracts and any notifications necessary to avoid such conflicts are the sole responsibility of the client. 
b) The client assumes all responsibilities for obtaining any necessary permission, clearance permits, etc., which may be, required for One Vision Films to video each event, public or private. The client assumes all responsibility for obtaining and retaining permission for access to any requested camera positions and is solely responsible for the quality of the final production resulting from the use of, or inability to use, such camera positions. 
c) The client warrants that he/she does not have the legal rights to anything One Vision Films will film, including photos, musical recordings, videos, or any other materials delivered to One Vision Films for inclusion in the client’s film. 
d) The client agrees to indemnify and hold. One Vision Films reserves the right to use videos and photos for display and or promotional purposes. 
e) All video masters, raw footage, videos and photographs remain the exclusive property of One Vision Films. 


2. Artistic Style: 


On its own behalf and on behalf of the subject: The client acknowledges: 
a) That he/she is familiar with the Company’s portfolio and is requesting services with knowledge of the company’s style and that the Company’s work is constantly evolving; that the Company's services are of a unique and artistic nature. 
b) That the video may be different from a video completed by the company in the past; and that in creating the photos or videos we shall use our own creative artistic judgment to create content consistent with our personal judgment to create images and videos consistent with our interpretation of the event, which may be different from the clients and or the subject’s interpretation of the event. 
c) That the client acknowledges that the videos shall not be subject to rejection on the basis of taste or aesthetic criteria. The Videographer shall be granted artistic licence in relation to the footage filmed, poses and any photographs and locations used. 
d) That the Videographer’s judgement regarding the locations/poses and number of clips or shots taken shall be deemed correct. Due to vagaries of Weather and willingness of subjects, it may not be possible to capture all the footage/images requested. 


3. Portfolio and expectation: 
a) The client has critically viewed samples of One Vision Films video’s and hereby grants full editorial and production control to One Vision Films for all aspects of the production and post-production services for the event. 
b) In the event a particular segment is either not recorded, partially recorded, or not a part of the edited master tape, it is at the sole discretion of One Vision Films as the exclusive producer of the event video recording. 


4. Booking Fee/Deposit Payment: 
a) A non-refundable deposit of £100 as well as full acceptance of the terms and conditions as published and provided to the client secures the time and service of the Videographer for the Wedding. 
b) The Deposit is non-refundable or transferable in the event of a cancellation, it being agreed loss suffered by the Videographer due to cancellation. 
c) The deposit will be deducted from the clients chosen package price. Payment in full of the remaining balance is due 8, (eight) weeks prior to the Wedding date/date of filming, but can also be settled at any time before this.
d) Weddings that are postponed to a later date will retain the deposit as long as the Videographer can reschedule for the new date. 
e)  Whereby notice of a booking is made 12 weeks or less before the Wedding Day/day of filming, immediate payment is required in full as well as full acceptance of the terms and conditions as published to secure said booking.


5. Cancellation: 
a) The client(s) may cancel at any time by giving written notice to the Videography/s but in doing so shall forfeit any monies paid. 
b) Cancellation less than 12 (twelve) weeks before the wedding will result in the payment in full becoming due. 
c) All cancellations must be in writing. 
d) If the client cancel’s within 4-6 months before the date of the wedding, the client will receive a 50% refund on the package price if already paid in full. 


6. Wedding Arrangements: 
a) The details of the Wedding arrangements are to be agreed in writing. (email is acceptable). The client shall notify the Videographer of any changes to the details in writing. 
b) The Videographer cannot be held liable for delays or disruption in their delivery of the service until any changes are received and acknowledged in writing. 
c) The Videographer will provide a pleasing colour balance but cannot guarantee exact colour matching owing to anomalous reflectance caused by a combination of certain dyes and materials, especially man-made fibres. 
d) For a booking involving a church ceremony or at certain venues, the Videography’s movements are restricted by the official in charge. 
e) The area from which the Videographer is able to cover the ceremony may not be the Videographers choice and the Videographer cannot accept responsibility for any obstructed view should this be the case. 


7. General Data Protection Regulations: 
a) All information is kept securely and the Videographer is the only people that views this information. We NEVER share your data with any third parties. 
b) The client reserves the right to request that the videographer deletes their personal information, should they wish. 
c) The client will advise the Videographer of this in writing. 
d) The information we hold is your name, address, telephone number and email address should you have provided it to us. 
e) All personal property provided by the client to One Vision Films for utilization in the post- production of their film is received by One Vision Films at the complete and total risk of the client. 
f) One Vision Films will make every effort to ensure the safekeeping of a client’s personal property while in its possession and return same to client upon delivery of the edited master copy tape/final photo package. 


8. Attendance: 
  1. In the unlikely event of the Videographer being unable to attend your wedding due to unforeseen circumstances, we reserve the right to appoint another Videographer to attend your wedding on our behalf to undertake the Wedding to his or hers ability. 

b) If One Vision Films fails to comply with the terms of this agreement due to any event or at beyond the control of One Vision Films, including but not limited to illness, accident, labour disputes, acts of God and other catastrophes, or uncontrollable and unforeseeable equipment failure, One Vision Films’ liability is limited only to a refund of all monies received. 


9. Editing: 
a) All footage will be adjusted for exposure, brightness, contrast, sharpness etc. 
b) The Videographer’s judgement regarding these corrections and the number of images put forward to the client for preview shall be deemed correct. 
c) The claimant is aware that the post-production of all content is time consuming. 
d) The client understands that the Videographer works on multiple projects for other client’s. 
e) The Client is aware that the Videographer recommends a turn-around time for the delivery of your film to be approximately 6-8 weeks from the day of the shoot and is aware that on occasion, delivery of the client’s film may take up to 12 weeks. 
f) The client up-stand’s that this time frame is merely a guide. Should the Videographer require more time, the Client will be notified. 


10. Copyright: 
a) The copyright Designs and Patents Acts assign the copyright of the images to the Videographer. 
b) Any images or copies whether stored digitally or otherwise and any other computer programme including any source or object code, computer files or printed documentation relating to such images are protected by the Copyright and Design Act 1988. 
c) The Videographers images must not be edited in anyway without permission from the Videographer. 


11. Limitation and Liability: 
a) In the unlikely event of a total photographic failure or cancellation of this contract by either party or in any other circumstance the liability of one party to the other shall be limited to the total value of the contract. 
b) Neither party will be liable for indirect or consequential loss. Personal Accident: Any directions issued to clients, their guests or employees during a shoot are deemed to be at said person’s risk. 
c) The Videographer cannot be held responsible for any personal accidents during a shoot. Governing Law: This agreement shall be governed in accordance with the laws of England and Wales, and the client accepts these terms.
